Practice Area
Restructuring, Insolvency & Bankruptcy
Strategic legal advice for businesses and stakeholders navigating business distress, debt restructuring and insolvency, from early assessment and out-of-court solutions to formal bankruptcy processes.
Overview
We advise businesses, shareholders, creditors and investors on business distress, debt restructuring, insolvency and bankruptcy matters. Our work begins with early assessment of the business and its legal position, helping stakeholders evaluate available options and determine whether financial restructuring, out-of-court debt arrangements or formal bankruptcy procedures provide the most appropriate path forward.
We provide legal support throughout commercial debt restructuring and rescheduling, creditor and stakeholder arrangements, bankruptcy applications and court-supervised processes. Our work also extends to voluntary liquidation and forensic analysis of potential bankruptcy offences, combining preventative advice, restructuring solutions and formal insolvency support within a single practice.

Out-of-Court Debt Restructuring — GCC
Assessed the level of business distress and the viability of out-of-court restructuring for businesses across the GCC, and advised clients on restructuring priorities and negotiations with creditors, including a group of banks in Saudi Arabia, resulting in successful consensual settlements.
Bankruptcy Offences & Cross-Border Advisory — Saudi Arabia / UK
Provided legal support to a debtor with liabilities exceeding the equivalent of approximately £990 million in assessing claims involving alleged bankruptcy offences and defending its legal position. The work included advisory support in relation to proceedings brought by the bankruptcy trustee in the United Kingdom, focusing on the trustee’s authority to pursue claims before the UK courts and the applicability of Saudi bankruptcy rules in those proceedings.
Bankruptcy Trustee Decisions & Conduct — Saudi Arabia
Provided legal advisory support in one of Saudi Arabia’s most complex bankruptcy cases, involving liabilities exceeding the equivalent of approximately £5 billion, in relation to the bankruptcy trustee’s conduct and decisions. Our work contributed to the successful challenge and reversal of certain trustee decisions and, ultimately, to the trustee’s removal.
